Roger Clemens‘ statements branding his former trainer, Brian McNamee, a liar and suggesting that there were unknown facts that when disclosed would support his denials of the trainer’s accusations of having used steroids could form the basis of a defamation action under New York law. Additionally, Clemens’ statements that the trainer fabricated evidence were likewise actionable as defamatory.
